Ordinance in port

Pursuant to Article 84 of the Maritime Demesne and Seaports Act (»National Gazette«, No. 158/03, 100/04, 141/06, 38/09, 123/11, 56/16, 98/19), and Article 9, paragraph 2 of the Regulation on the conditions and methods of maintaining order in ports and other parts of internal waters and territorial sea of the Republic of Croatia ((»National Gazette«, No. 72/21), and the Maritime demesne concession agreement for the purpose of construction and economic use of a special purpose port, nautical tourism port “KREMIK”, dated 29th September 2002, as amended and supplemented, the concession holder, the company MARINA KREMIK d.o.o. Primošten, Splitska 22-24, PIN: 33994182010 (Management of the “Marina Kremik”), on 19th January 2022 issues:

ORDINANCE

on the order of the special purpose port – nautical tourism port – “Marina Kremik”

GENERAL PROVISIONS

Article 1

By this Ordinance, the concession holder MARINA KREMIK d.o.o. Primošten, Splitska 22-24, (hereinafter: the concession holder), prescribes the purpose of the special purpose port – nautical tourism port “Marina Kremik”, the reporting procedure, the method of arrival, mooring, berthing and departure of vessels, as well as the method of control over these activities, and the terms and conditions of use.

Article 2

Special purpose port – nautical tourism port (hereinafter the “Marina Kremik”), is intended for berthing of nautical vessels on a permanent berth, monthly berth, and daily and/or transit berth with a total of 393 berths in water, and 150 dry berths.

In the Marina Kremik, to the left of the travel lift, there is a petrol station for the fuel.

Article 3

The provisions of this Ordinance apply to all yachts and boats (hereinafter collectively: the “Vessels”) and all boat operators/masters and owners of ships, yachts, and boats, as well as persons employed or staying in the area of the Marina Kremik (hereinafter: “Users”).

Article 4

Certain terms, in this Ordinance, have the following meaning:

  1. User – is the owner of the Vessel (natural person or legal entity) who has concluded an Annual Berth Agreement (permanent berth) or Monthly Berth Agreement with the concession holder or uses the services of daily accommodation (daily or transit berth).
  2. Proxy of the owner – is a natural person for whom a Power of Attorney for permission to access the Vessel is deposited with the reception office of the Marina. The owner of the Vessel is obliged to fill in and personally sign the power of attorney.
  3. The master of the yacht is the person who operates the yacht.
  4. The boat operator is the person who operates the boat.
  5. The Captain is the person who manages the Vessel (boat or yacht).
  6. A Vessel in the sense of this Ordinance means all vessels (boats and yachts) that have a permanent berth agreement in the „Marina Kremik“ or use a monthly or daily (transit) berth or are in the area of the Marina Kremik.
  7. Mooring plan (Vessel layout plan) is a plan which determines and specifies the layout of vessels in the “Marina Kremik”.
  8. The body managing the port is “MARINA KREMIK d.o.o.” or the concession holder for a special purpose port – nautical tourism port “Marina Kremik”, whose bodies are:
  9. The responsible person of “MARINA KREMIK d.o.o.” is the Director of the Company,
  10. The responsible person of the Marina is the director of the “Marina Kremik” (representative of the Management of the Marina)
  11. Authorized person of the Marina for relations with guests, interpretations regarding issues of mooring of Vessels and customer relations – MARINA KREMIK d.o.o. in addition to the director of the marina are:

           Captain and Chief Receptionist;

  1. Other employees of the “Marina Kremik” are:

            receptionist, sailor.

  1. The Harbour Master’s Office is the Harbour Master’s Office.
  2. A concrete pier is a part of a separate fixed port area which is equipped for safe mooring of the Vessels.
  3. EKO SET is a set of aids consisting of a floating dam, coagulant, dispersant and auxiliaries, and is used to localize in case of pollution in the “Marina Kremik”.

Article 5

The area of the “Marina Kremik” includes the land and sea part as determined by the Maritime Demesne Concession Agreement for the purpose of construction and economic use of the special purpose port – nautical tourism port “Kremik” as amended and supplemented and consists of 93.250 m2 of sea and 42.123 m2 of land. Total area of sea and land amounts 135.373 m2 and includes following plots: part of the land plot 19710, part of the land plot 4165, part of the land plot 4134/1, the land plot 4134/2, building plot 1465, building plot 1317, building plot 1318, building plot 1319, building plot 1230, building plot 1231/1, building plot 1231/2 and building plot 1232, all c.m. Primošten as marked on a copy of the actual state in scale 1:2000 which forms and integral part of the said Agreement.

BERTH CAPACITIES

Article 6

“Marina Kremik” is intended for mooring and berthing of Vessels with capacity for 393 Vessels up to a maximum length of 30 meters and draft up to 4 meters.

Berthing for Vessels are piers marked with letters from A to J.

“Marina Kremik” determines the berth of the Vessel in accordance with its Mooring Plan and reserves the right to move the Vessel to another berth without the prior consent of the User when necessary or for safety reasons (due to the need to berth larger Vessels or extraordinary events such as fire, sinking, force majeure, etc.).

REPORTING PROCEDURE

Article 7

Upon sailing into the Marina Kremik, the User is obliged to announce the arrival by radio at channel VHF 09.

Upon sailing in or arrival by land to the Marina Kremik, the User is obliged without delay to report the arrival at the reception of the Marina, along with submitting the Vessel’s documents as follows: compulsory insurance policy of Vessel, Certificate of Registry for Vessels flying the flag of the Republic of Croatia, and for foreign Vessels documents corresponding to the above documents and a confirmation of payment of fees for safety of navigation and protection against pollution, as well as crew passports.

SAILING INTO THE MARINA

Article 8

At the notable speed reduction sign, the Vessel is obliged, when sailing next to the other Vessels and facilities to be protected from waves, and near areas where coastal or underwater works are performed, to sail at the lowest speed so that waves caused by navigation do not interfere with works and do not cause damage.

Sailing in is carried out with due care in regard to other Vessels, by the shortest way, without delay, by sailing on the right side of the waterway and at a speed of up to 2 knots, or not more than the minimum possible speed for a given type of the Vessel, i.e. the Vessel arriving to the Marina Kremik, and when departing from the Marina Kremik during navigation they must reduce the speed in the Marina so that the waves caused by their navigation do not cause damage to other Vessels and devices in the Marina Kremik.

The Management of the Marina is obliged to place a table (white background) on the breakwater head with a noticeable warning (black letters) on both sides in English stating: “Speed limit 2 knots”.

Article 9

When reporting arrival at the Marina, the person operating the Vessel is obliged to report to the competent Harbour Master’s Office any extraordinary event that occurred during the voyage, which endangers the safety of navigation and human lives, and if sea pollution was observed.

Article 10

When the Vessel arrives to the Marina Kremik, and there is a danger that there are people suffering from quarantine disease on the Vessel, the Management of the Marina shall inform the competent Harbour Master’s Office and the competent sanitary body to inspect the Vessel.

Article 11

If the Vessel loses part of the equipment or part of the cargo in the Marina Kremik, the person operating the Vessel is obliged to inform thereof the Management of the Marina without delay, with designating the position of the event.

BERTHING

Article 12

Sailors of the Marina Kremik on duty at the berth are obliged to navigate the Vessel from the entrance to the Marina by showing the flag to the berthing spot, provide assistance with mooring, and welcome the User and direct the User to the reception.

Article 13

Vessels are generally moored at the stern towards the shore, except in places where side mooring is mandatory.

Mooring is carried out by correct bindings, with the appropriate dimensions and in a nautically safe way. Moored bindings must not interfere with navigation. Improperly moored Vessels will be properly moored by the sailors of the Marina Kremik at the expense of the User. The User is obliged to provide appropriate ropes for mooring the Vessel to the pier, and to maintain the mooring ropes in good condition.

Article 14

The person operating the Vessel must, when sailing, docking, mooring and unmooring the Vessel in the Marina Kremik, act in such a way that these actions do not endanger human lives, pollute the sea, or damage his Vessel, as well as other Vessels, shore, devices, installations and facilities in the Marina, by collision, impact or grounding.

Article 15

Assistance in mooring in the Marina Kremik is performed at the request of the User with the working vessel of the Marina Kremik. The User is obliged to request help timely.

As an exception to the provision of paragraph 1 of this Article, in case of bad weather, simultaneous manoeuvring of several Vessels, when safety of navigation and human lives is endangered or marine pollution may occur, and in other justified cases, the Management of the Marina may order assistance in mooring with the Marina Kremik working vessel.

When several Vessels are requesting for berth assistance simultaneously and there are not enough work vessels, the Management of the Marina determines the order of priority, taking into account whether the safety of navigation and human lives are endangered or sea pollution can occur.

Article 16

According to the Mooring Plan the Management of the Marina assigns the Vessel’s berth in the sea or accommodation on land and is the only one authorized to relocate the Vessel if deemed necessary or at the request of the User.

When choosing a berth in the Marina Kremik, the User must take care of the already berthed Vessels, and mooring must not interfere with the navigation of other Vessels.

The manner of mooring of the Vessel referred to in paragraph 1 of this Article shall be determined by the Management of the Marina, in accordance with Article 13, paragraph 2 of this Ordinance.

Article 17

The Management of the Marina is obliged to provide the Vessel with the priority of mooring in the Marina Kremik when human lives are endangered.

The Management of the Marina Kremik may, for the purpose of safety of navigation, order each Vessel, with prior notice, to move to another berth or to move from its assigned place.

At the request of the Management of the Marina, the User is obliged to allow one or more Vessels to be moored at his berth or next to his Vessel, and to maintain a connection with the coast through his Vessel.

The Management of the Marina Kremik is obliged to maintain the facilities and assets built or placed at the shore in a condition that does not pose a danger to human lives and safety of navigation, in accordance with special regulations.

ARRIVAL OF THE VESSEL BY LAND

 

Article 18

Before transporting the Vessel to the Marina Kremik by land, by a towing vehicle on a trailer or truck, the owner of the Vessel is obliged to inform himself about the regulations related to the entry of the vessel into the Republic of Croatia, and to timely announce the arrival of the Vessel in Marina Kremik.

In case of arrival to the Marina Kremik by land, by a towing vehicle and a Vessel on a trailed, the captain of the Vessel is obliged to report his arrival at the gateway of the Marina Kremik.

If a Vessel arrives by land only in transit, the captain of the Vessel is obliged to present the entire crew’s identification documents at the gateway of the Marina Kremik, so that the crew members can be registered as guests, and following that, the captain must open a work order at the reception for lowering the Vessel into the sea and for parking the vehicle and the trailer.

The captain of the Vessel is obliged to present at the reception regarding the transit all the necessary documentation pertaining to the Vessel and obtain a prepaid card for entering and leaving the Marina Kremik.

The captain of the Vessel, having opened a work order at the gateway of the Marina Kremik, is given back the identification documents together with the mandatory form GUEST REGISTRATION for each person.

The captain of the Vessel, a foreign person, who has a Permanent Berth Contract with the Marina, is obliged to report each of his arrivals at the gateway of the Marina Kremik and present the identification documents of the entire crew (foreign citizens) so that the crew members could be registered as guests.

DELIVERY OF THE VESSEL FOR SAFEKEEPING

Article 19

Acceptance of the Vessel for safekeeping is considered completed when the crew makes the prescribed preparations and at the reception hands over the navigation permit, a copy of the compulsory and casco insurance policy, and third-party liability insurance policy, and the keys to the interior, and pays the berth fee.

Preparation of the Vessel for safekeeping by the Marina Kremik includes the following actions:

  • disconnecting the electrical power supply (refers to both possible sources of power supply: power supply from the mainland or own batteries),
  • disconnecting the Vessel’s connections from the water supply installations,
  • removing all flammable and explosive materials from the Vessel,
  • installing own properly certified fire extinguishers near the entrance to the Vessel’s interior,
  • checking the level of accumulated water in the lower parts of the Vessel,
  • closing all valves on the openings located on the underwater part of the hull of the Vessel,
  • checking the correctness and reliability of the bindings of the Vessel,
  • removing movable equipment from the deck and open parts of the superstructure and storing them in the interior of the Vessel,
  • locking the entrance to the interior of the Vessel.

The delivery of the Vessel for safekeeping to the Marina Kremik shall be deemed completed at the moment when its captain performs the preparatory actions prescribed in paragraph 2 and when he hands over the following documents and items to the Marina reception office:

  • navigation permit (vignette),
  • a copy of the compulsory and casco insurance policy for the Vessel,
  • the keys to the interior of the Vessel,
  • a copy of the Vessel Owner’s passport.

By returning the keys and/or by navigation permit to the User or a person authorized by the User by the reception, and/or at the moment of entry of the User or a person authorized by the User on the Vessel and/or taking over the Vessel’s documents at the reception of the Marina Kremik, the Marina Kremik is released from any responsibility, regardless of whether the Vessel is left on the berth or is in navigation and all the responsibility of the Marina Kremik for safekeeping ceases, regardless of whether the Vessel is left on the berth or is in navigation.

STAY IN THE MARINA

 

Article 20

The Marina Kremik is obliged to display the daily meteorological report at a visible place at the reception every day. In case of arrival of extremely adverse weather conditions due to which the safety of the Vessel, crew and passengers may be endangered, the Marina Kremik shall inform about it via VHF channel 09 by a general invitation to the captains of the Vessels located in the Marina Kremik.

The person operating the Vessel is obliged to report his arrival to the reception of the Marina Kremik immediately upon arrival at the Marina Kremik, and before starting the embarkation or disembarkation of passengers, along with presentation of a crew and passenger list, as well as confirmation (vignette) of payment of safety of navigation fee issued by the competent Harbour Master’s Office, and confirmation that customs and police formalities have been completed.

If the Vessel enters the Marina Kremik at a time when the reception is closed, the arrival report is submitted to the reception at the beginning of working hours.

Based on the report of arrival to the Marina Kremik, the reception of the Marina Kremik issues a permit allowing the stay in the Marina Kremik to the Vessel.

Article 21

The Vessel located in the Marina Kremik at the sea berth must be capable to manoeuvre.

As an exception to the provision of paragraph 1 of this Article, the Management of the Marina may, at the request of the User, approve the repair of the engine in the Marina.

Article 22

The Management of the Marina will deny the consent for berthing to the shore to the Vessel when it endangers the safety of navigation, safety of human lives and facilities on the shore or at sea, and if the Vessel is in such a condition that it would pollute the sea and/or endanger human lives and property of other Users.

The Management of the Marina will prohibit the Vessel from entering the Marina Kremik or departure from the Marina, if due to adverse weather conditions the safety of the Vessel or persons may be endangered.

Article 23

The Management of the Marina may, for reasons of safety of navigation, safety and protection of human lives and the environment, port and other facilities, with prior notice, order that the already berthed Vessel be moved to another berth or moved from its assigned place, and that the Vessel be removed from operational shore to a specific position.

If the User is not available or does comply with the request referred to in paragraph 1 of this Article, the Management of the Marina may relocate the Vessel at the expense and risk of the User.

Article 24

Without prejudice to the duty to assist the Vessels in distress, the Management of the Marina may deny the consent for the berthing of the Vessel on the operational shore for justified reasons, i.e. when there are reasons that such berthing would endanger the safety of navigation, safety of human lives and facilities on the shore or at sea, and if the Vessel is in such a condition that it would pollute the sea or would imperil the safety of other Vessels or property of the Users in the Marina Kremik. Vessels in distress, which also pose a threat to the safety of navigation, safety of human lives and facilities on the shore or at sea, will be accepted and placed on a specially designated berth marked in the graphic as an emergency berth.

Article 25

The Vessel located in the Marina Kremik must be moored with appropriate and correct bindings on mooring devices (cleats, mooring buoys, rings, etc.).

The Management of the Marina is obliged to maintain devices referred to in paragraph 1 of this Article and to obtain appropriate documents for them.

Article 26

If the User operating the Vessel notices that there are objects in the Marina Kremik that endanger the safety of navigation or that may damage other Vessels, port facilities, devices, installations and facilities or pollute the sea, he must immediately notify thereof the competent Harbour Master’s Office and the Management of the Marina.

Article 27

In case of storm, the Vessels berthed at the Marina Kremik must strengthen their bindings and, if necessary, sail out or take shelter in the lee. If the Vessel is handed over for safekeeping in accordance with Article 19 of this Ordinance, Marina Kremik will take the above actions if necessary.

If the Vessel does not have enough fenders, bindings or if the bindings are not of sufficient strength and length, i.e. it does not have the appropriate equipment, the Management of the Marina shall order it to be supplied with the appropriate equipment.

If the Vessel is not supplied with the appropriate equipment, the Management of the Marina will prohibit it from docking at the Marina Kremik.

Exceptionally, for reasons of safety of navigation and safety of the environment, the Harbour Master’s Office may temporarily declare and announce the Marina Kremik or the part of the Marina Kremik closed to traffic.

Article 28

Moorings of Vessels berthed in Marina Kremik must not interfere with the navigation of other Vessels, and with the movement of persons along the shore.

Tender boats equal or smaller than 2,5 m and small auxiliary boats and equipment from Vessels berthed in the Marina Kremik may not be located on the operational shore or at sea without the approval of the Management of the Marina.

Article 29

If another Vessel can dock in front of or behind the Vessel moored at the operational shore in the Marina Kremik, the moored Vessel must visibly mark its bow or stern and, if necessary, both parts of the Vessel.

Article 30

It is prohibited to perform actions on the Vessel during stay in Marina Kremik that may endanger human lives, cause fire, pollute the sea or cause damage to other vessels, as well as the coast, port devices, installations and infacilities.

Decanting of fuel is not allowed in the waters, i.e. in the area of the Marina Kremik.

Article 31

Performing works on the Vessel located in the Marina Kremik can be carried out only with the prior written approval of the Management of the Marina.

The Management of the Marina determines the place for the performance of works and safety measures that must be taken during the performance of works.

If the works on the Vessel are performed by a repairer hired by the User, the repairer is obliged to report upon arrival and departure from the Marina Kremik, upon which the Marina Kremik issues a written approval for performance of works in the area of the Marina Kremik, along with the payment of the appropriate fee determined by the Marina Price List.

The repairers who, based on the written approval of the Management of the Marina, perform works on Users’ Vessels in the Marina Kremik, are obliged to have and present a valid third-party liability insurance policy, regarding damage from and/or in connection with works that could occur on other Users’ Vessels and/or the property of the Marina Kremik.

The Marina Kremik is not liable for damages caused by repairers, contractors, proxies of the Vessels’ owners and third parties, regardless of whether they provided services within the Marina Kremik with the approval of the Management of the Marina.

Article 32

The User is obliged to request the approval of the Management of the Marina for the performance of works on the Vessel at least 48 hours before the commencement of works, together with presenting the description of works, the time of performance of works and the contractor who will perform the works.

After the works are completed, the contractor is obliged to clean the used part of the coastal area.

Article 33

The Management of the Marina is obliged to secure the acceptance of waste generated during the performance of works.

Article 34

The Management of the Marina is obliged to clean the Marina Kremik from waste that endangers the safety of navigation and pollutes the sea.

Article 35

The supply of drinking water and electricity to the Vessel is allowed only in the presence of the Vessel’s User by using the correct connections to energy cabinets.

Connection of the Vessel to the power supply from the land is allowed only with the correct cables, according to the declared power at the sockets of the energy cabinets, while the User is on the Vessel.

Taking drinking water from the water installation in the Marina Kremik is allowed only with the correct pipes with the use of the correct water gun. After taking the water, the hose should be disconnected and placed on the Vessel.

Charging of ship batteries by connecting to the sockets of energy cabinets on land is allowed only in the presence of the User and/or with the notification to and supervision of a qualified and authorized person designated by the Management of the Marina.

Article 36

If the Vessel or sunken item endangers the safety of navigation or there is a risk of sea pollution, the User of the Vessel or the sunken item is obliged, at the request of the Management of the Marina, to move the Vessel or the sunken item from the Marina Kremik to a place determined by the competent Harbour Master’s Office.

The User, i.e. the authorized person is obliged to extract or remove the wreck or sunken item at his own expense. If the User, i.e. the authorized person does not extract or remove the wreck or sunken item, he shall be liable for the damage caused to third parties in connection with the wreck or sunken item.

The approval of the competent Harbor Master’s Office is required for the removal of a wreck or a sunken item, save for the removal of a wreck or a sunken item that does not require special nautical and technical tools and special expertise.

Removal of a wreck or sunken item that does not require special nautical and technical tools and special expertise does not require the approval of the Harbor Master’s Office if the value of the item is negligible and the item does not have a cultural property or military significance.

When the competent Harbor Master’s Office determines that the wreck represents a danger, it will render a decree and order the owner to remove the wreck and will set a reasonable deadline by which the owner is obliged to remove the wreck.

If the User of the Vessel or the sunken item does not act according to the request of the Management of the Marina referred to in paragraph 1 of this Article, the Management of the Marina shall transfer the Vessel or the sunken item from the Marina Kremik to the place determined by the competent Harbour Master’s Office, without prejudice to the rights pertaining to the concession holder as an honest finder based on the provisions of the Maritime Code of the Republic of Croatia.

Article 37

The Vessel moored in the Marina Kremik which has not been delivered for a safekeeping in accordance with Article 19 of this Ordinance, is taken care of by the User and he is responsible for any damage caused by the Vessel to other Vessels, shore, devices, installations or facilities.

The Owner of the Vessel is obliged to insure the Vessel against liability for damages caused to third parties.

Article 38

While the Vessel is in the Marina Kremik on berth, under repair or modification without the User, the Management of the Marina is obliged to ensure the safekeeping of the Vessel during the day and night, so that in case of danger it enables its rescue.

The User hands over the Vessel to the crane for manipulation at its responsibility, both in terms of material damage, which would occur especially due to the poor condition of the Vessel, due to devices that were not dismantled before manipulation, due to falling of the Vessel due to windy conditions or due to installed parts on the hull of Vessel that would be damaged by lifting.

ACTION IN THE EVENT OF MARITIME ACCIDENTS

Article 39

In the event of a maritime accident in Marina Kremik during the User’s stay on the Vessel (grounding, fire, sinking, listing, pollution of the sea, loss of mooring system, etc.) the User is obliged to notify the Management of the Marina without delay and to call the emergency services if such assistance is required.

The Management of the Marina is obliged to notify the Harbor Master’s Office about occurrence of the marine accident.

If the Vessel is damaged or threatened with pollution of the sea and/or the environment, the Management of the Marina is obliged to transfer the Vessel without delay to the emergency berth indicated in the graphic presentation attached as an Appendix 1.

Following notice on the pollution, and after the Harbour Master’s Office has been notified, sailors employed with the Marina Kremik, as professionally trained, approach to the localization of pollution.

Article 40

The marginal coastal area in the Marina Kremik must be permanently free, and in the part of the port where the embarkation or disembarkation of persons takes place, it must be specially fenced or visibly marked.

The width of the marginal coastal area is determined by the Management of the Marina.

Article 41

When embarking, disembarking and reloading passengers and baggage, the User must take the necessary measures in order to eliminate any danger to the safety of people and property, and to protect the sea from pollution.

When manipulating objects, the User must take appropriate measures to prevent objects from spilling into the sea and the coast.

After the completion of embarkation, disembarkation, transhipment or performance of any other action, the contractor is obliged to clean the used part of the coastal area.

Article 42

Embarking and disembarking of persons in the Marina Kremik is possible only from and to Vessels that stay in the Marina Kremik, over the prescribed bridges or stairs provided by the Vessel.

Persons and their luggage may not be loaded or unloaded over the fence of the Vessel.

Article 43

On the part of the shore designated for embarkation and disembarkation of persons, the Management of the Marina is obliged to provide a place for mooring of Vessels and free area for access of persons.

Article 44

The User shall park his personal vehicle in the designated area. If the User departs from the Marina yet leaves the vehicle in the Marina he must deposit the vehicle keys with the reception. All improperly parked vehicles shall be moved by the employees of the Marina at the risk and cost of the User.

Article 45

In the Marina Kremik it is forbidden to:

  • in any way endanger the safety of navigation, human lives and the environment;
  • prevent access to mooring devices;
  • relocate, exchange and remove bindings and devices of other vessels except when necessary to prevent immediate and obvious damage or when necessary due to the arrival or departure of the vessel;
  • tie Vessels to navigational and other signs and devices not intended for mooring and moving on them;
  • install satellite dishes, showers and other devices on the piers and moorings;
  • hang and wash laundry on the piers or in the area of the Marina Kremik;
  • damage operational shores with heavy vehicles, by placing heavy objects over the permissible load, drive wedges, beams, etc. into the shore, and lift stones from coastal walls or perform any other action that damages operational shores;
  • light a fire on an open hearth on the shore or on a Vessel or on mooring devices, weld, leave on the Vessel or next to the Vessel open containers with highly flammable or explosive materials, or in any other way cause a fire hazard;
  • incinerate waste on the Vessel;
  • clean and scrape and paint the surface or underwater part of the Vessel’s hull and perform on the Vessel repairs and reconstruction of the hull, deck, equipment and machinery;
  • pollute the air by releasing dust, smoke and other gases above the permitted quantities determined by special regulations;
  • keep the ship’s propeller in operation, except to perform the necessary manoeuvre of the Vessel;
  • leave the engines or any other technical devices that use gas or electricity running, or have rechargeable batteries switched on when no crew member are on board;
  • swim, dive, fish, speedboat, windsurf, water ski and wind surf;
  • sail at speeds greater than 2 knots;
  • discard, dispose of or discharge solid, liquid or gaseous substances that pollute the Marina;
  • wash, clean, paint, polish and the like using chemical agents (detergents, solvents, paints) that could get into the sea and cause environmental pollution;
  • place signs, advertisements and other messages;
  • disturb public order and peace in the Marina – by creating noise disturb the peace of other guests, especially at night from 22:00 to 08:00;
  • use the services of third parties to supervise, maintain or perform work on the Vessel without the approval of the management of the Marina;
  • release pets without a leash and owner supervision. Pet owners are required to keep the Marina environment clean;
  • have unauthorized persons stay or move in the operational area of the Marina;
  • leave boat tenders, dinghies or long equipment from the Vessel on the piers and the shore;
  • move the Vessel to another berth without the consent of the Management of the Marina;
  • use the ship’s toilet and empty faecal tanks and bilges into the sea;
  • anchor the Vessel with its own anchor inside the Marina;
  • pour or transfuse fuel and other flammable liquids;
  • bring and leave a camping house in the area of the Marina Kremik;
  • use caravans and campers foy stay in the area of the Marina Kremik;
  • pour waste oil, oil or other fats and detergents into the sea;
  • keep an auxiliary boat, surfing or other equipment at the access to berths as well as for a purpose that is not necessary for arriving o departing from the berth;
  • move near the crane;
  • use the UHF device while the Vessel is at berth.

For violating the measures referred to in paragraph 1 of this Article, the Management of the Marina has the right to cancel the berth and, depending on the severity of the violation, submit a report to the competent Harbour Master’s Office/its branch office to take appropriate measures.

DEPARTURE FROM THE MARINA

Article 46

Before departing from the Marina Kremik, the User is obliged to report the departure to the Management of the Marina by checking out at the Marina reception, and to request the assistance of the Marina sailors during the departure, if he needs it. The sailors of the Marina are obliged to provide assistance when departing during bad weather and if the User so requests.

The report of the departure shall be submitted no later than one hour before the departure of the Vessel.

Based on the report of the departure, the Management of the Marina issues a departure permit to the Vessel.

After the report has been submitted and the permission to depart has been obtained, the Vessel is obliged to leave the Marina within one hour. If it fails to do so, it is obliged to re-register its stay at the Marina Kremik.

Vessels on a daily berth, i.e. in transit, should leave the Marina no later than 12:00 next day. Upon the expiration of the said period, the fee for the next day would be charged, and so on until final departure of the Vessel.

Article 47

The departure is performed with due care in relation to other Vessels. The shortest route, without delay, sailing on the right side of the waterway and with speeds of up to 2 knots, i.e. not exceeding the minimum possible speed for a given type of Vessel.

 

REPORTING AND ACCEPTANCE OF WASTE FROM VESSELS AND CARGO RESIDUES

Article 48

The User, if there are waste oils, fuels and lubricants, and solid and liquid substances on the Vessel, is obliged to keep them until entering the Marina Kremik, and report and hand them over in accordance with the Waste Management Plan at the Marina Kremik (or outside it) where there are devices for receiving them.

Article 49

Before departing the Marina, the User must hand over all waste from the Vessel to the reception facilities of the Marina Kremik.

REFUSAL TO PROVIDE THE SERVICE

Article 50

In case of non-compliance with the Ordinance in the Port Marina Kremik, the Management of the Marina reserves the right to deny consent for a Vessel to remain in the Marina Kremik.

The Management of the Marina reserves the right to take other necessary actions that are not specified in this Ordinance, if it is in the interest of protection of persons, property and the environment.

INSPECTION SUPERVISION

Article 51

Inspection supervision over the application of this Ordinance shall be performed by navigation safety inspectors and other authorized employees of the Ministry and the Harbour Master’s Office.

In case of breach of the provisions of this Ordinance, the Harbor Master’s Office is authorized to initiate misdemeanor proceedings against the person who breaches and/or acts contrary to the provisions of this Ordinance.

PROVISON OF FUEL

Article 52

The fuel supply in Marina Kremik is provided at the gas station located to the left of the travel lift according to Appendix 1 – Plan – maritime demesne Marina Kremik with an overview of berths and the location of the emergency berth, and gas station. Pursuant to the Sub-Concession Agreement dated 5.7.2012, and Annex 1 to the Sub-Concession Agreement dated 19.10.2015, the gas station is in the sub-concession of Petrol d.o.o. “BP Marina Kremik”

MISCELLANEOUS

Article 53

All Users of services in the Marina Kremik can enter their impressions and complaints in the “Appeal Book” at the reception of the Marina.

FINAL PROVISIONS

Article 54

This Ordinance shall enter into force after obtaining the consent of the Harbour Master’s office Šibenik, and it shall be published after obtaining the consent of the competent Harbour Master’s Office on the notice board of the Marina Kremik.
